These Terms of Service (“Terms”) govern your access to and use of the website at thecosmolab.com and your interactions with The Cosmo Lab, LLC (“The Cosmo Lab,” “we,” “us,” or “our”). By accessing or using our website, you agree to these Terms. If you do not agree, please do not use our website.

1. Who We Are

The Cosmo Lab is an appointment-only salon in Poway, California that provides space and a shared environment to independent hair stylists. Our website provides information about the salon, our stylists, and our services, and lets you contact us or a stylist.

2. Independent Stylists

Each stylist at The Cosmo Lab is an independent business owner, not an employee or agent of The Cosmo Lab. Stylists set their own service menus, pricing, availability, booking, and cancellation, payment, and refund policies, and are solely responsible for the services they provide. The Cosmo Lab does not control and is not responsible for the services, conduct, pricing, or policies of any individual stylist. Any agreement for hair services is strictly between you and your chosen stylist.

3. Appointments & Booking

Booking is handled directly by each stylist, generally through a third-party platform (MangoMint). When you book, you agree to that stylist’s policies, including their cancellation, late, no-show, and payment terms, which are presented during booking and on the stylist’s page. Cancellation and other fees are charged by the stylist, not by The Cosmo Lab.

4. Booth-Rental Inquiries

Submitting a booth-rental inquiry does not create any lease, license, or other agreement. It is a request for information only. Any rental arrangement is subject to a separate written agreement and our approval. Information you provide should be accurate and your own.

5. Communications & SMS

By providing your contact information and consenting on our forms, you agree to receive communications from The Cosmo Lab and/or our stylists as described in our Privacy Policy, including SMS text messages where you have opted in. Message and data rates may apply; reply STOP to opt out. Consent is not a condition of any purchase.

6. Acceptable Use

You agree not to:

Use the website for any unlawful, harmful, or fraudulent purpose;
Submit false, misleading, or another person’s information;
Attempt to gain unauthorized access to our systems or disrupt the website;
Copy, scrape, or misuse our content, or infringe our or others’ intellectual property.

7. Intellectual Property

The website and its content — including text, graphics, logos, the “The Cosmo Lab” name and branding, and design — are owned by The Cosmo Lab or its licensors and are protected by intellectual property laws. You may not use them without our prior written permission, except as necessary to view the website for personal, non-commercial use.

8. Third-Party Services & Links

Our website may link to or rely on third-party services (for example, MangoMint for booking, Google, and Instagram). We do not control and are not responsible for third-party services, their content, or their terms and policies. Your use of them is at your own risk and subject to their terms.

9. Disclaimers

The website and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure, or that any information is complete or current. Hair services involve individual results that we and our stylists cannot guarantee.

10. Limitation of Liability

To the fullest extent permitted by law, The Cosmo Lab and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the website, your dealings with any independent stylist, or any services provided by a stylist. To the extent we are found liable, our total liability for any claim relating to the website will not exceed one hundred U.S. dollars (US $100).

11. Indemnification

You agree to indemnify and hold harmless The Cosmo Lab and its owners, members, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the website, your violation of these Terms, or your violation of any rights of another.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the website will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the website after changes take effect constitutes acceptance of the updated Terms.
